Welcome to our website. These Terms and Conditions govern your use of this website and the purchase of any products or services from Engavory and Ink & Engrave. By accessing this website or placing an order, you agree to be bound by these terms.

Terms & Conditions 

1. About Us

2. Use of Our Website

  • By using this website, you confirm that you are at least 18 years old or are accessing the site under the supervision of a parent or guardian.

  • We reserve the right to update, modify, or remove any part of this website or these terms at any time without prior notice.
     

3. Products & Services
We operate under two distinct brand offerings on this platform:

  • Ink & Engrave: Our ready-to-buy retail shop featuring physical made-to-order items, personalised goods, and instant digital downloads.

  • Engavory: Our commercial and bespoke studio providing custom laser engraving, 3D printing services, professional design consultation, and corporate branding solutions.

Note on Variations: Product imagery on our website is for illustrative purposes. Because many physical items are individually crafted, made-to-order, or utilise natural materials, final items may vary slightly in finish, colour, or texture.

4. Pricing & Payment

  • All prices are listed in GBP (£). We are not currently registered for VAT.

  • Accepted Payment Methods: Payments for shop orders are handled securely online via Square. Custom studio bookings and commercial services are payable via official online invoice or Square link only. We do not accept cash.

  • Payment Terms: Full payment is required before any retail shop order is processed, shipped, or digital file access is granted. For custom commissions, design work or production will not begin until the required deposit has cleared (see Section 5).

  • We reserve the right to correct pricing errors. If an error affects your order, we will contact you to cancel or amend it.
     

5. Deposits & Production Locks (Custom Orders Only)

  • All custom commissions handled under the Engavory brand require a 50% non-refundable deposit at the time of booking to secure studio production time and raw materials.

  • Orders booked at short notice (within 3–5 days of required collection or dispatch) must be paid in full upfront.

  • Final balances must be cleared in full before any custom items are dispatched, delivered, or collected.
     

6. Order Acceptance & Cancellations
An order submitted by you constitutes an offer to purchase. An order is only legally accepted by us when you receive an official dispatch or order confirmation email.
 

  • Shop Orders (Ink & Engrave): Once a retail order is placed, it enters our production queue and cannot be cancelled or amended.

  • Custom Orders (Engavory): Custom project bookings can only be cancelled before physical production or custom design work begins. The initial 50% deposit remains strictly non-refundable to cover administrative and material locking costs. Once physical production has commenced, the order cannot be cancelled, and the full outstanding balance remains due.

  • Digital Downloads: All digital downloads are strictly non-cancellable and non-refundable once the file delivery or download link has been transmitted.
     

7. Shipping, Delivery & Digital Access

  • Digital Downloads: Access to digital files is instantly granted via an emailed link or through your user account upon successful payment.
     

    • ⚠️ EU Sales Restriction: Due to EU VAT regulations on digital goods, we strictly do not sell digital downloads to customers located within the European Union (EU). Any digital orders placed from EU countries will be cancelled.
       

  • Physical Deliveries: Physical goods are shipped within the UK using fully tracked services (such as Royal Mail Tracked 24/48). Delivery dates are estimates only.

  • Tracking & Risk: Every physical package is tracked. Ownership and risk of the goods pass entirely to you upon verified courier delivery confirmation or GPS drop-off data. We are not liable for missing parcels where tracking data confirms successful delivery to the address provided.
     

8. Returns & Refunds
Our return policies strictly follow the UK Consumer Contracts Regulations exemptions:

  • Personalised & Made-to-Order Shop Items: Because the vast majority of our products are individually made-to-order or customised to your specifications, these items are strictly final sale and cannot be returned or exchanged unless they arrive fundamentally faulty or damaged.

  • Non-Personalised Shop Items: If you purchase a standard, non-customised item, you have 14 days from delivery to notify us of a return.

    • The item must be completely unused, unaltered, and in its original packaging.

    • The customer is entirely responsible for the cost of return postage and must use a tracked service.
       

  • Digital Downloads: Digital items are strictly non-refundable. By completing your purchase, you expressly agree to gain immediate access to the file and acknowledge that you waive your statutory 14-day cooling-off right to cancel or claim a refund.
     

  • Damaged or Faulty Goods: If any physical item arrives damaged or incorrect, you must email clear photos of the item and its original packaging to us within 48 hours of delivery (kirsty@inkandengrave.com for shop items; kirsty@engravory.com for custom commissions). Do not return items to our business address without receiving instructions and the correct returns address first.
     

9. Customer Content (For Custom / Engraving Work)
When providing text, designs, logos, or materials for custom engraving or 3D printing orders, you guarantee that:

  • You own or have explicit legal permission to use the content.

  • The design does not infringe upon any third-party trademark, copyright, or intellectual property rights.

  • The content complies fully with UK law.

  • You grant us a non-exclusive, royalty-free licence to use, modify, and reproduce the content solely for the purpose of fulfilling your order.
     

10. Intellectual Property

  • All content included on this website, along with our physical product designs, digital design files, templates, and original artwork, are the exclusive intellectual property of Engavory and Ink & Engrave.

  • You are strictly prohibited from copying, reproducing, redistributing, reselling, sharing, or modifying any digital downloads or physical product designs without our express, written permission.
     

11. Limitation of Liability

  • Nothing in these terms limits our liability for death or personal injury caused by negligence, or for fraudulent misrepresentation.

  • To the fullest extent permitted by UK law:

    • We are not liable for any indirect, incidental, or consequential losses, or loss of profits arising out of your use of our website or products.

    • Our total liability to you for any claim shall not exceed the exact amount paid by you for the specific product or service in dispute.

    • Digital products are sold on an "as-is" basis. We make no guarantees that our design files will be universally compatible with all external cutting, engraving, or slicing software/devices.
       

12. Privacy & Data Protection
Your personal data and privacy are critical to us. Any information you provide is handled strictly in accordance with our Privacy Policy, which complies with the UK GDPR and the Data Protection Act 2018.
13. Governing Law
These Terms and Conditions are governed exclusively by the laws of England and Wales. Any legal disputes or claims arising from these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
